What rights do nursing home residents have in New York?+

New York Public Health Law §2801-d creates a private right of action for nursing home residents whose rights are violated. Residents have the right to dignity, adequate medical care, freedom from abuse and restraint, and to be free from chemical and physical restraints used for staff convenience.

What are the signs of nursing home abuse or neglect?+

Unexplained bruises, cuts, or burns; pressure sores (bedsores) that could have been prevented; sudden weight loss or dehydration; poor hygiene; fearfulness around staff members; unexplained falls; sudden changes in behavior or mood.

What is the statute of limitations?+

Three years under CPLR §214 for general negligence claims against the facility. For claims under Public Health Law §2801-d, the same three-year period applies. Act quickly — facilities often attempt to transfer residents after complaints are raised.
