Who can file a wrongful death lawsuit in New York?+

The personal representative (executor or administrator) of the deceased's estate files the lawsuit. The recovery is distributed to the distributees — spouse, children, parents — under New York law.

What damages are recoverable in a wrongful death case?+

Economic damages include lost earnings and financial support the deceased would have provided over their lifetime. The estate can also recover for the pain and suffering the deceased experienced before death (survival action). Pecuniary losses to family members are recoverable.

What is the statute of limitations for wrongful death?+

Two years from the date of death under EPTL §5-4.1. This is shorter than the general personal injury statute of limitations. Do not wait.
