Workers' Compensation Attorneys — New York City

Hurt at Work
in New York?
You Have More Options Than You Think.

Workers' compensation covers your medical bills and a portion of lost wages — but it's often not the full picture. If a third party's negligence caused your workplace injury, you can sue them separately for full damages including pain and suffering. We pursue both.

What We Handle

Every Type of Workers' Compensation Case
in New York

👷

Construction site injuries

The most common source of workers' comp claims in NYC. We simultaneously pursue workers' comp benefits and Labor Law §240/241 third-party claims against the property owner and general contractor.

👷

Repetitive stress injuries

Carpal tunnel, tendinitis, and back injuries from repetitive work are covered by workers' comp. Proper documentation of the work activities that caused the injury is critical.

👷

Occupational disease

Asbestos exposure, chemical exposure, and other occupational diseases are compensable under workers' comp with specific filing requirements based on the date of disability.

👷

Third-party claims

If your workplace injury was caused by defective equipment, a dangerous property condition, or another company's negligence, we pursue the third-party lawsuit that workers' comp alone cannot provide.

👷

Denied claims

Insurance carriers routinely deny valid claims. We represent injured workers in Workers' Compensation Board hearings and appeals to fight denied and disputed claims.

👷

Employer retaliation

Firing, demoting, or threatening an employee for filing a workers' comp claim is illegal under New York law. We pursue retaliation claims aggressively.

Workers' Compensation Questions
We Hear Every Day

Does workers' comp cover all workplace injuries?+

Workers' compensation covers injuries that occur in the course of employment, regardless of fault. It covers medical treatment and two-thirds of your average weekly wage, up to the state maximum. It does not cover pain and suffering.

Can I sue my employer?+

Workers' compensation is generally the exclusive remedy against your direct employer. However, you can sue third parties — property owners, general contractors, equipment manufacturers — whose negligence contributed to your injury. These third-party lawsuits can recover full damages including pain and suffering.

What is the deadline to file a workers' comp claim in New York?+

You must notify your employer of the injury within 30 days. The workers' compensation claim must be filed with the Workers' Compensation Board within two years of the injury date.

What if my employer doesn't have workers' comp insurance?+

New York requires all employers to carry workers' compensation insurance. If your employer is uninsured, the Uninsured Employers Fund (UEF) provides benefits. We pursue every available source of recovery.
